COPYRIGHT & USE OF IMAGES

The Photographer retains the copyright in all photographs taken during the pop-up session.

Images purchased by the Client are supplied for the Client's personal use only. The Client may download, print and share their purchased images for personal, non-commercial purposes, provided the images are not altered in a way that materially changes the photograph.

Purchased images may not be commercially reproduced, sold, licensed, entered into competitions, used for advertising or otherwise exploited without the Photographer's prior written permission.

Unpurchased images remain the property of the Photographer and will not be supplied to the Client unless subsequently purchased or otherwise agreed in writing.

The Client must not screenshot, screen-record, photograph, copy, download or otherwise reproduce any unpurchased image. Any such action will constitute a breach of these terms and does not grant the Client any right to use or reproduce the image.

The Photographer may retain digital images for a period of up to one year for administration and re-order purposes. After this period, the Photographer may delete the images and cannot guarantee their continued availability.

THE PHOTOGRAPHER

The Photographer will take reasonable care in providing the photography service. However, the Photographer is not responsible for loss, damage, injury or expense arising from circumstances beyond the Photographer's reasonable control.

The Photographer is not responsible for the supervision, care or control of children.

The Photographer will take reasonable steps to protect and preserve photographs and digital files. However, the Photographer cannot be held responsible for loss or damage caused by circumstances beyond their reasonable control, including equipment failure, technical failure, data corruption, loss during processing or storage, or other unforeseen circumstances.

Where the Photographer is unable to provide the agreed service due to circumstances beyond their reasonable control, the Photographer's liability will be limited to the amount actually paid by the Client for the affected service, to the extent permitted by law.

PAYMENT & IMAGE SELECTION

The pop-up photography session is provided free of charge. The Client is under no obligation to purchase photographs.

Photographs are available for purchase individually or as part of the packages offered by the Photographer. Prices will be clearly displayed or communicated to the Client before purchase.

Once an image order has been confirmed and paid for, the Photographer will provide the purchased digital images in the agreed format within ten (10) working days.
